The Health PPP Law No. 6428 was amended by Law No. 7151 published in the Official Gazette on 5 December 2018. Law No. 7151 introduced two amendments to the Health PPP Law in relation to the market testing for services and the adjustment of the operation term performance bond amount.
The first amendment to the Health PPP Law has brought a distinction for non-compulsory volume medical support services in terms of adjustment of the Services Payment to be made based on a market testing procedure. Accordingly, the amendment to the Health PPP Law envisages that the Services Payment adjustment will be conducted once in every 10 years for non-compulsory volume medical support services and other services will continue to be subject to market testing once in every 5 years.
The second amendment provides that the operation term performance bond amount will be subject to an annual adjustment based on local producer price index (Yİ-ÜFE) to be announced by the Turkish Statistical Institute (TÜİK).
