License-exempt Electiricty Generation Limit increased to 5MW

On May 10, 2019, the maximum installed capacity limit for license-exempt electricity generation has been increased from 1 MW to 5 MW by the Presidential Decree No. 1044.

Pursuant to Article 14 of the Electricity Market Law No. 6446, among others, generation facilities based on renewable energy resources with a maximum installed capacity of 1 MW were exempted from the requirement to obtain a license from the Energy Market Regulatory Authority (“EMRA”). The President of Republic has the authority to increase this 1 MW installed capacity limit to 5 MW under the same article of the Electricity Market Law. Based on such power, the President increased the maximum installed capacity limit for license-exempt electricity generation to 5 MW on May 10, 2019. 

Accordingly, renewable energy based electricity generation power plants with an installed capacity of up to 5 MW are exempt from the requirement to establish a company and to obtain a license from EMRA to generate electricity.
